Analyzing Due Process Decisions IDEA provides protections and rights to families of students with disabilities who are receiving special education services, including due process. Parents/caregivers have the right to due process if they have a conflict with their child’s school relating to the services the child receives. It is important that teachers understand due process as they may be called upon to share data regarding a student in a due process hearing.
